General Terms and Conditions Chalet Zur Rose Berwang
It is advisable to read these terms carefully before making a reservation. Here you will find the rights and obligations of you (tenant) and Chalet Zur Rose Berwang (lessor) for the apartments Nelke, Frauenschuh, Alpenlillie, Zyklame and Alpenrose
1. Reservation
1.1 These General Terms and Conditions apply to all our reservations. Deviations are only possible in occasional cases and if they are confirmed in writing by Chalet Zur Rose.
1.2 The client is jointly liable for the fulfillment of all obligations by themselves and all co-travelers arising from the reservation confirmation.
1.3 We only accept reservation requests from persons who are eighteen (18) years or older. Reservations by persons younger than that age are also not valid.
2. Reservation Order and Payment
2.1 Every reservation order is confirmed by Chalet Zur Rose Berwang by means of a reservation confirmation via email.
2.2 Within two weeks after receipt of the reservation confirmation, the deposit of 35% of the total travel amount (hereinafter jointly “the rental sum”) must be paid. The remaining rental sum must be paid no later than 4 weeks before the arrival date. For reservations less than 4 weeks before the arrival date, the full rental sum must be paid immediately.
2.3 In case of untimely payment, Chalet Zur Rose Berwang is entitled to cancel the reserved accommodation. The cancellation terms then remain (unmodified) in force.
3. Cancellation by tenant
3.1 Cancellation must be communicated to Chalet Zur Rose Berwang by e-mail. Upon receipt of the cancellation, Chalet Zur Rose Berwang will send you a cancellation confirmation/invoice.
3.2 The following cancellation refund costs apply. Chalet Zur Rose Berwang advises you to take out a cancellation insurance.
• up to 4 weeks before the arrival date 50% of the total travel amount;
• from 4 to 2 weeks before arrival 80% of the total travel amount;
• from 2 weeks before arrival to the arrival date no refund, the tenant is liable for the full rental sum.
The deposit of 35% of the total travel amount is not refunded upon cancellation.
In case of early departure or later arrival than the booking agreement, the lessor is entitled to demand the full agreed price.
4. Cancellation by Chalet Zur Rose Berwang
4.1 If, except for the situation mentioned in paragraph 6, Chalet Zur Rose is forced to cancel the reserved accommodation, the relevant tenant will be informed directly and, if possible, offered an alternative. If the tenant does not accept this alternative, or if an alternative cannot be offered by Chalet Zur Rose Berwang, the lessor will immediately refund the amount already paid by the tenant.
The tenant has no other rights than to recover this amount.
4.2 In case of detrimental use of the accommodation, ruthless, offensive or otherwise grossly inappropriate behavior that disrupts the coexistence of other guests, the lessor is entitled to terminate the stay immediately.
5. Liability of the tenant
5.1 During the stay in the accommodation, the tenant is fully liable for the rented accommodation, the furnishings and all items belonging to the rental. Any damage or loss to or in the accommodation caused by the users of the accommodation or elsewhere in Chalet Zur Rose Berwang must be immediately fully reimbursed by the tenant to the lessor. Chalet Zur Rose Berwang is entitled to hold the tenant liable if the caused damage is not, or not properly, settled or if the costs are not (entirely) paid by the tenant. All related (collection) costs are borne entirely by the tenant named in the reservation confirmation. For damage and/or defects that are not reported to the management of Chalet Zur Rose Berwang no later than the day of arrival, the liability stated above applies.
5.2 The apartments are suitable for a maximum occupancy of the number of persons indicated on our website. Therefore, it is not allowed to stay with more persons than indicated in the apartments. Chalet Zur Rose is entitled to refuse access to the accommodation if occupancy by more than the allowed number of persons occurs.
6. Liability of Chalet Zur Rose Berwang
6.1 Chalet Zur Rose Berwang accepts no liability for loss, theft, damage or personal injury of any kind.
6.2 Obvious errors or mistakes in the description or prices of the accommodations offered by Chalet Zur Rose Berwang do not bind the lessor. For interim changes in data, prices or printing errors, Chalet Zur Rose Berwang cannot accept any liability.
6.3 The (price) information on the website is decisive.
6.4 Chalet Zur Rose Berwang cannot accept liability for damage caused by natural forces, natural disasters, nuclear disasters, attacks, strikes, acts of violence and contact with an aircraft or its parts.
6.5 It may happen that work is carried out near the rented accommodation. For any noise disturbance or other inconveniences, Chalet Zur Rose Berwang takes no responsibility.
6.6 Austrian law applies to all our reservation agreements and subsequent arrangements. All disputes that may arise in relation to an agreement will be settled by the competent court.
6.7 No refund of the travel amount will take place in the event of “force majeure” including, but not limited to, a damage event such as a natural disaster, attack, epidemic, molestation or danger threatening you during the trip. This also applies if the infrastructure is so affected that the trip cannot reasonably be made.
